1. Acceptance of Terms

By accessing or using Kumty ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

Kumty is an enterprise value execution operating system (EV-OS) providing project management, portfolio tracking, risk management, AI-assisted planning, and related services delivered as a cloud-based SaaS platform.

3. Account Registration

  1. You must provide accurate and complete registration information.
  2. You are responsible for maintaining the security of your account credentials.
  3. You must notify us immediately of any unauthorized use of your account.
  4. One person or legal entity may not maintain more than one free account.

4. Acceptable Use

You agree not to:

  1. Use the Service for any unlawful purpose or to violate any laws.
  2. Attempt to gain unauthorized access to any part of the Service.
  3. Interfere with or disrupt the integrity or performance of the Service.
  4. Upload malicious code, viruses, or other harmful content.
  5. Use the Service to store or transmit content that infringes third-party rights.

5. Data Ownership

You retain all rights to your data. We do not claim ownership of any content you submit to the Service. You grant us a limited license to host, store, and process your data solely to provide the Service.

6. AI Features

The Service includes AI-powered features. All customer data is anonymized before being sent to external AI providers. We do not use your data to train AI models. AI-generated recommendations are advisory only and should be reviewed by qualified professionals before acting upon them.

7. Payment Terms

  1. Paid plans are billed in advance on a monthly or annual basis.
  2. All fees are non-refundable except as required by law.
  3. We reserve the right to change pricing with 30 days' written notice.
  4. Failure to pay may result in suspension or termination of your account.

8. Limitation of Liability

To the maximum extent permitted by law, Kumty shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

9. Termination

Either party may terminate this agreement at any time. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination.

10. Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
